Hello All,

I am running 6th year on my H1B visa and H1B expiring on Aug 22nd 2006.

Filled labor (PERM) under EB3 in March 30th 2006.

Labor (PERM) - April 7th 2006 (Approved)
I-140 - July 3rd 2006 (Approved)

Country of Birth (COB) is India.

Q1. When can I file my I-1485?
Q2. What is the current priority date running right now and how can I check on web site?. What is the web link for checking current priority date?.
Q4. How soon I will get my Green Card?
Q4. As you know my H1B is expiring on Aug 22, 2006, Can I get 3 years extension now as my I-140 has been approved?.

Only when your PD becomes current

Current PD is 01 Apr 2001

I am sorry to say you will be waiting a looooooong time. Right now the PD is moving only 15 days per month
Q4. As you know my H1B is expiring on Aug 22, 2006, Can I get 3 years extension now as my I-140 has been approved?.

Q1: Only when PD is current
Q2: EB3 India affected by retrogression... currently April '01 Visa Bulletin
Q3: After I-485 approval (months or years!!)
Q4: I believe you only get 1 yr ext...but mutiple times.

Q1. My laywer has already applied for 1 year extension. But in the mean time my I-140 got approved so can I amend the exisiting petition or do we have to file another petition asking for 3 years extension?.

Q2. As my petition for 1 year is not approved yet. My visa is expiring on Aug 22 2006 so can I stay here in US even after my visa is over on Aug 22 2006 on the basis of receipt number.?

I am not sure about this maybe someone else can help you or check with the lawyer. But either way you can always file another extension next year too.
