Regarding I-864

I am a U.S. Citizen and I am filing GC for my spouse (who is on H1 B).
I was not earning for last couple of years, hence, my spouse's cousin is willing to become a co-sponsorer (she does not live with us, hence filling a separate I-864).
I am trying to fill form I-864 for me as well as for my spouse's cousin and I am confused regarding few questions.
I request you guys to guide me. Thanking you in anticipation.

PG. 1, PART 3, PONIT # 8
There is a checkbox just before " I am sponsoring the principal immigrant named in Part 2 above".
Questions:
Should I check this on my I-864?
Should my husband's cousin check this on her I-864?

Then just below this, there are 2 more check boxes, one for 'Yes' and second for 'No (Applicable only in cases with two joint sponsors)
Questions:
Which Box should I check? Yes or No?
Which Box should my husband's cousin check on her I-864?

PG. 2, PART 4, PONIT # 19
CITIZEN/RESIDENCY
There are 3 options -
"I am a U.S. Citizen"
"I am a U.S. national (for joint sponsors only)"
"I am a lawful permenant resident........"
Questions: (I am sure, the 3rd option is not applicable to us)
Which Box should I check on my I-864? Option 1 or 2?
Which Box should my husband's cousin check on her I-864? Option 1 or 2?

Can you fulfuill the income requirement by including your spouse's income? I'm assuming H-1B spouse makes enough $$? It might make filling out the form a little easier than having joint sponsors etc.
 
Yes, my spouse makes enough to fulfil the income requirement and moreover we have been living together for more than 6 mths, but USCIS officer (infopass) told me that we cannot include my spouse's income in afidavit of support, since he is the beneficiary and hence we decided to take my spouse's cousin as a co-sponsorer.
Please can you help me with the questions I have posted above.

I don't know the answers to your question, but do know that as per I-864 instructions you can include your spouse's income:

Can the Intending Immigrant Help Me Meet the Income Requirements?

If certain conditions are met, the intending immigrant's income can help you meet the income requirement. If the intending immigrant is your spouse, his or her income can be included if it will continue from the same source after he or she obtains lawful permanent resident status.


But if you so desire, I will not discuss this option anymore.

Ok, let's see, I reviewed the forms to some extent. As I understand you are the "petitioning sponsor" and your husband's cousin would be the only "joint sponsor."

So Part 3 Q8: Yes for you, yes for joint sponsor. Yes you check the box on Q8 because you are sponsoring the principal immigrant only.

For your part 4 question, definitely you should check citizen. I don't know what a US national is. If the cousin is a citizen, I'd check citizen.

I still think you should petition with your husband's income if he intends to continue the same employment... always better not to get too many family members involved in legal financial contracts, avoids trouble in the future. :p But that said, do as you please!

What does this mean? Which box should I check on my I-864? and which box should my spouse's cousin check on his I-864?

The answer is "yes" for your spouse's cousin because there is only one joint sponsor. The "no" is for multiple joint sponsors where each sponsors a different intending immigrant. As for yourself, I would think you would also check "yes" (you're stilla a sponsor ... the petitioning sponsor) but help me out, does it say anywhere in your form I-864 that you have a joint sponsor that fulfills the income requirement? I would think it does.
 
You are excellent and extremely helpful. Made my life so easier.

No where it says on the form I-864 that I have another co-sponsorer.
But I guess, I am selecting 1 a) on Part 1, which says that I am the petitioner and the co-sponsorer has to select 1 d) I am the only joint sponsor. I think this is the only way to know who is what.


I have a question in regards to I-485.
Pg. 1, B, 10
- it is asking for my Alien Registration Number. Now I am currently a U.S. Citizen but before that I was on Green Card and had Alien Registration Number, so I have to write that or just leave it blank (N/A).
