Regarding H4 to H1 transfer
I am a doctor presently on H4 visa valid till september 2003 and i got a residency offer with H1 sponsorship.I can extend my H4 status till 2004 Dec as my husband changed his job and has a I 94 till 2004( visa stamping till sep 2003 on his passport ).Now I will be filling for H1 thro premium processing and once its approved,i am planning for a vacation to homecountry and come back in june to start residency.I have few quiries
1)can I come back on a valid H4 and start the residency on H1 as i dont want to get H1 stamped at this time(dont want to take even 1% chance of H1 rejection).
2) Is it a must that if v leave the country once H1 is approved that passport should be stamped with H1 before entering US
3)Suppose if my H1 is rejected (hope not),can i reenter US with H4 status which is valid till sep 2003 or should i again apply for H4
4)Also I am planning to Toronto for 4 days of vacation,so should i get the H1 stamped before entering US,,,i read somewhere here that if v dont submit I-94 then there wont be a problem,,is that ok not to submit I-94 when v leave the country even canada for that matter
5)If i dont leave the country is it that H1 automatically kicks in on the start date i.e july 1st without even getting H1 stamped on my passport and stay legally after sept with H1 approval even though passport stamping from homecountry is valid till sep '03
