Regarding extension of h1b visa

Hi,

I am currently in US. My h1 b visa is expiring on September 2004. Can I apply for the extension of h1 visa from US and continue working here, or do I have to leave the country. Does the new rule regarding h1b relate to this ? Please let me know..

Hello,

You can file extension of your H1 from USA. Ask your Lawyer to file an extension for another 3 years. You can file extension within 4 months from your expiry date, so i feel you should do it fast.
The NEW RULE about H1 is for the 'Visa revalidation" i.e. the Visa's stamped on the passport. They have discontinued doing the Visa stamping on your passport here.
So once you get extension, and if you wish to travel outside USA, you have to get the VISA stamped from any US Consulate outside USA (it is better chance to go to your home country). If you do not wish to travel, it is not necessary to get the VISA stamped on your passport, you can continue working with your H1 Extension.
Remember, Visa Extension & Visa revalidation (Visa stamping on your passport) are two different things.
