During Appeal of your NIW Petition can you apply for Advance parole?
My NIW petition was rejected by the Nebraska Service center in Nov. 2005, while I was using my EAD card which was valid till Sept. 2006. My lawyer suggested me to appeal the decision & also apply for a new NIW at Texas center. In the meantime I got a new H1B from the company. In order to start working with it I have to get a visa stamp, for which I have to go out of USA.
Can anybody tell me if I can apply for advance parole; either on my appeal or on my new application?
Or can anybody suggest me any other way to solve this problem.
Is it possible to stay & work in US till the decision of appeal is received?
