Reg US entry options for married spouse GC holder

Hi,
I am writing on behalf of my sister. She was in US from 1997-2000. She did her masters in electrical engineering from univ of new orleans. She got her OPT after that around 2000, and did intership for a while and went back to stay with parents.
After that she stayed in India from 2000-2005 and during this time she worked in 2-3 companies for sometime (she worked only for 2-2.5 yrs of this 5 yrs).
She then got married in Jan,2005 and came to US in Mar 2005. Her husband was on H1B at that time and he also had applied for GC, was in third stage. He tried to apply for her for a dependent green card. Due to unexpected circumstances she had to go back to India in Apr 2005, but her green card application couldnt be completed when she left, it was never submitted. Now her husband is on EAD (I think that means he went through all stages of GC and is just for Department of State to give him his GC). and she wants to come to US now. She applied for a couple of universities for masters in Computer engineering/Computer Science and got admits from them, and from one of them she was given a partial fee waiver. She wants to do another MS with specialization in different field diff from her first masters.
Questions:
1. The problem we have now is that since student visa we should prove we dont want to immigrate and her husband already already has EAD, and waiting for GC (meaning wants to immigrate), what kind of docs should she show to consulate officer and at port of entry to proove that she doesnt intend to immigrate.
2.What other options does she have to come to US? She sincerely wants to go for higher studies and wants to work for sometime in US.
3.Can someone please suggest some good attorneys who could be of help here in US and who are reliable...
