Hi,

I received the following confirmation from the Delhi and Chennai consulates regarding the H1B change of employers, old valid visa (company A) and new petition (company B).It seems you can travel and work for new employer on current valid visa even if it is from the previous company. You do need to take with you the new petition (I 797A) and show it at the POE.The POE officer is then supposed to give an I-94 expiry date based on the new petition expiry date and not the expiry date on the visa.

Request all seniors (Simran,Murali, et all) to pl provide their feedback on this....Thanks!

Dear Sir or Madam:

This is in response to your nonimmigrant visa inquiry.

After changing H-1B employers an H-1B visa holder may continue to use his or her original H-1B visa for entry into the United States. Upon applying for entry, the visa holder must present the new I-797A, Notice of Action evidencing the approval of the change of employer in addition to the visa.

Hope this information is useful to you.

Sincerely,
Consular Section

H1-B visa holders and their dependents who are returning to the U.S. on a valid visa, but who have changed their employer in the U.S., do NOT require a new visa -- however they must carry their new I-797(original) while traveling.

Information from US consulate is very clear, if you have valid visa from old employer and now working for different employer with valid I797 docs you are safe and no one can stop at port of entry in US.Be happy.
