Hello All,
I am new to this forum and I have a quick ques for you.

We (MY hubby and I ) came to USA on L1 Visa so accordingly I ma on L2 Visa .
When we were in India ,my hubby applied for H1 Visa .In the mean time we came here .My hubby got approved for H1 as well.

On L2 , I applied for my EAD .and my duration of EAD is 3 yrs .
Now my ques is ....
My husband is planning to go to India and get stamped for H1 . So,

#1 ) He would lose his L1 status ..that is ok for us .

Is it that I need to also accompaNY him to get myself stamped or as my EAD is valid fr 3 yrs .I can stay here and wrk ..on my EAD and he can go and get himself stamped for H1.
We are new to USA so we r not aware of the rules .Pls help us.

Waiting fr reply.
Thank You,
Priya

Your EAD becomes invalid automatically if you lose your L-2 status. You have to maintain your L-2 status in order for the particular EAD to be kept valid. But your L-2 status is not independent-you will lose your L-2 status if your husband switches his status to H-1B.

1. You need to accompany your husband to India to change your visa from L-2 to H-4.

2. Once your status is no longer L-2, you won't be able to use your EAD to work. With H-4 you won't be eligible to apply for an EAD as you may know.

3. If your husband decides to maintain his L-1 status by sticking with his current employer, you will be able to maintain L-2 status thus continue using EAD.
