Hi,

My employer informed me recently that my Labor has been approved and will be filing for my I-140.But I have not received any approval notices like you get when your H1 is approved e.g. I797.

Can anyone please tell me what notice the employee gets? Do you think the copy will be with my employer and he hasn't given it to me yet for some reason? I just wanted to ensure that there is some proof with me.

Thanks in advance,

You will not receive any kind of I-797 as the DOL processes PERM cases - not the USCIS. The attorney will receive the original approved labor certification, and the employer will receive a courtesy copy of the cover page of the LC, notifying them of its certification. For your I-140, you will need copies of all of the documentation that was prepared with the labor certification (educational documents, experience letters, etc.) along with your most recent paystub and a copy of your W2's since when you have worked with the company. You will need to sign one page of the labor certification (original) also to submit with the I-140 petition.
