Refusal to Terminate /Unpaid salary

I am working with a NJ based company from 2 yrs and suddenly they reduced my saalry that i think is less than min state wages and then stopped paying at all .I asked for termination they told they dont want to terminate.They r forcing me to send out of country with out paying any thing (past dues) and not giving proper termiantion letter/experience letter.and forcing to send me out of country as my visa is alos expering .
pease advice what should i do to get my hard earned money .

Obviously you are owed money and you should recover this money whether in USA or overseas. You may need legal representation. Just a letter from an attorney to your company should greatly help matters. Call Rajiv Khanna or Jim Mills (or any other attorney you wish) on Monday and see how they can help you. That\'s regarding the money.

The other problem is your expiring I-94. Unless you file an extension or move to another legal status before the expiry date, you will have to leave the USA. The employer is required to provide an air ticket (if that helps). Note that being out of status for 6 months invokes a 3 year ban and being out of status for greater than 1 year invokes a 10 year ban.
 
HI Status

I applied for H1 transfer before expiration of visa/I-94 and employer will take me on payroll as soons as they get a receipt number . is taht ok , for legal status ?
 
Did you send proper, complete documentation ?

Including recent pay stubs, etc? If yes, then you should be ok otherwise an RFE may be generated.
