reentry time frame that you can stay outside?

Hi Gurus,

This question I am posting for one of my friend. My friend got GC in 2004(he came is 1997 on H1B) but had to go back to Indian in July 2005 due to family problems. He is working in India for the same company( works online ) and gets paid the same that goes directly to his bank accounts in US. He already has applied for his reentry permit also.

His question is:

Does he need to come back to US before July 2006 in order to safeguard his GC status? (He can come back for a month and will go back again based on his problems there in India). Previously I was informed that you have to come back every six months in order to keep the GC status intact(and have no problem when applying for citizenship). Now he said the rules have changed and he can stay almost a year instead of six months. So he wants to know if that is true. He wants to make sure that his GC status is ok and he would have little problem during his citizenship interview...

Please let me know if anyone has a clear understanding in this situation.

thanks

N-470?

Extending the question above, how is 'travelling' seen as a reason for staying away from the US for a period of 6 to 11 months? Assuming that one maintains a life here with accounts, taxes, investments, is this an acceptable reason for an immigration official? Does anyone have experience with this?

Also, what is the continuous residence requirement? And what is a N-470 and how easy/difficult is it to obtain a N-470? If one is away for more than 6 months, what repurcussions does it have in applying for a citizenship?

Thanks Guys for the information.

This is what I infer from your answers:

1. He has a reentry permit so now that has kicked into effect since he stayed more than 6 months outside the country.

2. When comes back permanently he will start his residency requirements right from scratch instead of 2004(thats when he got the green card).

Let me know if I understood this right.

thanks

Actually, I have the same question.

Hello Guys.

This is my story: I came here as REFUGEE (Not Asylee) and now I have the Green Card. I have the same question that the one has Originate this conversation but I would like to include some of the information posted in the www.uscis.gov web page which from my point of view is relevant.

International Travel
"A Permanent Resident of the United States can travel freely outside of the US. A passport from the country of citizenship is normally all that is needed. To reenter the US a Permanent Resident normally needs to present the green card (Permanent Resident Card, Form I-551) for readmission. A reentry permit is needed for reentry for trips greater than one year but less than two years in duration".

But besides that they say:

"Remain outside of the US for more than one year without obtaining a reentry permit or returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year".

I want to know if can i travel to my origin country for one month without have reentry problems.

I almost forget it: I had an appointment with an immigration department official last week because I wanted to ask directly where the GC was issued. She said the only thing I need to show to reentry is the GC. She also said, it does not matter what status have you had before the GC but one we have it all we share the same status.

Now, another question comes to my mind. How many kinds of green card are here in USA? Do they identify which green card has been issued because a student status or because a married status?

Thanks

Thanks. I really appreciated it. I am still looking for an answer to my questions. The information you gave me has been so helpful.

Thanks Again.

Calculating The six months outside US on GC

Hi,
I have a question regarding how to calculate the start and end of the six months time period that we can legally stay outside US on a GC. I went to my country of origin for a business trip in June last year and stayed for 2 months and than came back and went again after 3 months for another 2 months (came back in december). So my question is how should i calculate the start and end of my six months window so i can plan my trips accordingly. When does my new six months start? is it from june this year? I anyone can explain this with examples i would really appreciate.

Thanks
