Reenter the US after Landing

Hi everyone,

Does anybody reenter the US after landing to Canada with a valid I94 and expired US visa?

I am planning to landing in June. I cannot revalidate my H1 visa in the US since it has expired for over one year. I am planning to go to Canada just for 3 to 4 days and will not apply for new H1 visa there. As I remembered the new rule says I should be able to reenter. Does anybody have the experience?

How can you have expired visa and valid I-94?

And your re-entry depends on whether or not you have a commonwealth passport that is in the visa waiver program.

But I am still confused about your valid I-94 and expired visa thing...

This is not uncommon actually. My visa was expired because it has a shorter validality period than my I94. And my I94 is still valid now. A person don\'t need to have a valid visa to stay in the US. Valid I94 is enough.

I would double check it

I believe the new law says that if your H1B visa is rejected in Canada, you can not come back with an expired visa. If I were you, I would double check it.

Yes, that\'s my question. the new rule says that if I am applying for a new visa and get rejected, I cannot reenter. But, how about I will not apply for the visa? Can I still reenter with the valid I94 and expired visa? The rule didn\'t clearly mention this....

In case u are giving a try dont forget to post your experience.

However I feel they will not let you into US on just I94 and expired
visa irrespective of your going to canada is for visit or visa stamping.

Did they still check your passport for any visa (no matter expired or not)? Also, did you cross the border after Apr. 1.
