Reconsidering AC21:Any known issues ?

I-140 approved, I-485 filed a year ago. I am working on EAD now.

Several months ago I was told by my lawyer that AC21 was a relatively new and uncertain law (denials on AC21 cases, employers withdrawing I-140, uncertainty about retaining or not original priority dates) and therefore I declined a job offer.

Now I am reconsidering this. It seems that these cut-off dates came here to stay. 300K 245i has potential to keep these cut-off dates frozen for at least a couple of years.

Given this lack of visa numbers, do you know whether the common sense is that people are invoking AC21 and jumping to another job ? Any known issues when using AC21 ? Consider I would take a very similar job position.

AC21 is safe!

IF you have a good offer and guaranteed yourself to stay with the new company for a long time, then go ahead...BIG companies with deep pockets and your continued survival...are the only things important to be considered for AC21. In addition, if you can negotiate with the new company to take care of filing your AC-21, you can rest assured.

If and when, PD becomes current and your case is taken up for adjuducation, they(CIS) will note that you have changed employer and will ask for a EVL, employment verification letter...again, no biggie.

Simply put, AC21 is paperwork...at the same time, there is certain responsibility on your shoulders to pick the right company to join...where you can "park" your GC...hope this helps.

OK, one of the hassles that I can imagine, is that suppose the new job turns out not to work out for whatever reason.

Then you would be out of work and you would need to find a "full-time" position, in the same or similar occupation. I think it is easy to find work thru employment agencies, but those restricitons to find full-time, "permanent" work in the same or similar occupation is what makes the whole thing very incovenient.
