Hi,everyone.I was here before fighting through my asylum case. I got recommended aproval back in 2005 and heard nothing from them so far. Meanwhile I got married to USC and had my I-485 interview. It was ok and the officer said we are approved, but one file didn't make it to the office, as soon as it gets there I'll get the card in the mail. well today i went to the office to ask about my case. They said it's the file from asylum and it's in transit.

now, i know it's all seems fine, but what if the file is lost or stuck, since is been 3 years now for my recommended aproval. they said it's namecheck, but the namecheck for marriage was cleared in a month after I filed. What do you think I should do? how long can I wait?

In that case, can't you withdraw your asylum application?

I would think I could, but with CIS your every single step is registered and a file created ( thats your immigration history) and for the final aproval they need to have all the files in one place. so i guess it doesn't matter if I withdrew it or not they need to have it.
My concern is whats if its lost?

I believe that when you withdraw your case, you will receive some sort of notice or document that would verify that your withdrawal has been accepted , no? ( only guessing though )..

Whether you withdraw or not, your original Alien file must be consolidated and received by the office that approved your I-485 interview. My best advise is to wait and keep going to ask in Infopass about the status of your file. Files are moved around alot but CIS should know the last location of your file because they actually have a file tracking system. Do not bother to withdraw just be persistent and have them retrieve your file from where ever it might be.

Goodluck....
