My friend is a Canadian citizen working in the US, initially brought in under a TN Nafta visa, and as of October 1 is approved for H1B.
He was married last month to a US citizen in Canada, but returned to the US as a TN (as the H1 is not active until Oct 1). Upon return from their honeymoon, he received news that he will be laid off work as of Sept 30.
He may have found work through another company willing to transfer the H1, but is not 100% sure if it will materialize.
What are his options, and what should he do?
I suspect that he will be able to file for Spousal Green card, but will he need to return to Canada, or will he be able to file that within the US while or while not working (eg. if he does not find work, will he be able to stay with the spouse?)
If he gets a job, would he be able to file as a TN? Are there any implications of getting a TN while applying for a Spousal green card?
