Recent tax year on affidavit of support, 'out of wedlock' question

Hi Guys,

I've a question about the affidavit of support I'm soon to file for my parents GC application. It asks for the last three years tax returns, and I haven't filed for 2009 yet. Does this mean 2008-2006? Any interpretations on this? And further on this; do all the tax years have to support the federal poverty guideline calculation, or just the most recent?

And (I've asked this before w/o answer yesterday on another thread): I (the USC) was born "out of wedlock" -- I was born when my parents weren't married yet. They married when I was about six years old. I have several birth certificates that were updated along the way. I have my very first birth certificate that only mentions my mother, then another birth certificate a few weeks later that correctly adds my (then) unmarried father, and a third birth certificate 6 years later that lists both my mother and my father under their married name. I suppose I'll only send my latest birth certificate in, but can this cause problems? (the birth certificate's date is a few years down the line) And if it does, so what? What do they need proof of? That my father was a father for me growing up? Isn't that evident in that they got married later? Is there any additional evidence I should be gathering?

Thanks for any answers and thoughts!

You will need to submit the tax returns for the years 2008-2006, since the tax year 2009 is not over yet.

Your current individual earned (i.e. what you are making now) needs to support the federal poverty guideline calculation (so all the tax returns of 2008-2006 don't need to). You can prove your income by: "a recent letter from your employer, showing your employer's address and telephone number, and indicating your annual salary. You may also provide pay stub(s) showing your income for the previous six months." (from form i-864).

Discloser: I am not a lawyer.
