Guys,

My concurrent 140-485 case with an RD of 03/25/04 (TSC) was transferred to a local office in Miami on July 04. My 140 is still pending and the case is in a totally different state than my state of residence. I have not received any update since then. Lately I have noticed a handful of people who are in similar situations.

I wanted to get this thread started so all of us who are in this situation can keep each other posted. This is a very peculiar situation since mostly 485s get transferred. The other peculiar thing is that the cases have been transferred to a local office outside that of the applicants state of residence.

If your case meets any of the below mentioned criteria then please post in this thread with your experiences.

1. Concurrenty filed 140-485 case transferred without 140 approval.

2. Case transferred to a local office outside of the applicants state of residence.

I believe that by sharing our experiences we maybe able to figure out what is going on. At this point I am not even sure if this transfer is legit or just a clarical error. I have been trying to find out the status for a long time.

thanks,

Our 485 case was transferred last week from CSC to our local office. This comes 1 day after responding to the 140 RFE. The 140 still shows that it is still being processed.

Here are the details of my case:

140 & 485 filed with Texas Service Center (TSC) October 12, 2004. EB3
Received Advance Parol and EAD cards November 1.
Reveived a letter from TSC on November 10 stating "In order to speed processing, your case has been transferred to Buffalo, NY local office. All future inquiries must be directed to that office". No updates since.

Thanks

Thanks Huifang and maybesomeday for posting on this thread.

Your situation is acutally not that bad because the case is atleast at a local office where you live. You may get lucky and both the 140 and 485 may get approved together after your interview. I think you just need to wait for the interview letter. I would go visit the local office to make sure the file is there. Give it atleast a month after transfer though.

You are in the same dilemma as I am. It will soon be 6 months since my transfer to Miami. Lots of guys that filed with me and after me have gotten their FPs done and their 140s have been approved. I am still suffering. I am a resident of Atlanta and still don't know why the case is in Miami. I have tried to get updates but have had no luck so far. The good news is that my company has agreed to start a congressional inquiry into my case. I just want to know if this is a legitimate transfer or a mistake. My fear is that it might turn out to be a mistake and my case will get delayed by the amount of time it stays in Miami. If it is not a mistake then I want to know exactly what the Miami office is doing. I will keep you posted on what I find. I am also planning a trip down to Miami in late Jan or early Feb. Lets see what happens.

It looks like I was worried too soon. After sending in our 140 RFE, the transferred the 485. They apparently kept the 140 and approved it a few working days later (yesterday). Thank god. I was dreading having to deal with the 140 and the 485 during the interview.
Best wishes to all of you.
