hello guys,
can anyone help w/ my case. i got rfe because my legal status in the past is not clear thru the passport photocopies that i submitted. i overstayed my student visa twice befor h1. it was never questioned until now.
i am required to submit all visa extensions, i94s, etc.
can i still use i245 or any other rule.
any help is appreciated.

Can you please share your data for tracking purpose? You are in the tracking list but we don\'t have your FPReceiveDate, FPDoneDate, FPScheduled date, when exactly RFE is issued, what is your exact RD, ND etc...

Regarding your status, I guess it is better to contact a good attorney because if you filed for 245(i) at the time of I-485 filing there should not be any problem (if you were out of status beyond 6 months) but don\'t know if one can add it at this point of time and how etc. I guess you were in status while filing for I-485 so it should not be a big probem to get these things properly fixed.

I don\'t understand how your attorney didn\'t catch this at filing time. since you were in legal status when you file your I485, I think your problem can be fixed. Where did you get your H1B visa stamp? I guess out of the USA since you were out of status. Just make sure that you consult a good attorney and work with him and try to understand evrything he does. remember that all most attorneys care about is money. wish you ggod luck and I think you;ll be fine. Just calm down

yes, the visa was stamped outside the country. after i overstayed my f1 visa, i have come back once w/ b1 and then h1.
i am planning to reply to rfe by monday/tuesday w/ $1000 fine.
