Received RFE (I485, RD: 12/22/2001)

Hi! All,
Now its my time to receive RFE. The online message says:

"On May 30, 2003, we mailed a notice requesting additional evidence or information in this case. The notice explains in detail what additional material is needed. If you have questions about the notice, what is required, or if 14 days have passed ........"

I guess it could be for Paystubs, W2 and Employer letter as I've changed my employer after 180+ days but never submitted AC21.

I've a problem with my salary. My w2 has reduced to 50% of the Labor salary requirement because of 50% bench period in last two years. But my last 2 months paystub salary matches the Labor requirement as I'm on project from past two months.
I spoke to my employer, he is a very nice Desi guy and he is ready to help me in providing any knid of documentation.

Now I'm worried, I don't know how to satisfy BCIS. Please suggest me.

Could anyone, please send me the format of AC21? I've changed my employer after 180+ days of I-485 ND. I guess with the above RFE, I need to submit the AC21 also and my attorney doesnot kow much about it. So I've to mail him the format of Ac21 and employer letter.

Better to wait for the letter to ascertain what docs they need. Even the best meaning desi will not or rather should not (for your own sake) mess around with W2.

just provide them with what documentation you have

nothing to worry about.

IMHO, they just want to make sure you are employed in a similar position.

If they just ask for employment letter and/or paystubs (for how long - it varies), you should be fine.

Just wait until you receive it, maybe they want something lesser than your history for the last 2 years.

Even if they do, just send them what you have. THe reason I say that is that they asked me for 2 paystubs and employment letter while i changed jobs 2 weeks before RFE was issued. my new paychek was only for one week (started middle of paycycle) and had missed a payperiod in between, but I still sent in the last paycheck from the last employer and the new paycheck, and I was approved.

Don't worry. In this kinda economy they will approve as long as you have a job that pays you above poverty guidelines, which would most likely be the case.

Does anyone know how to find out what skills was used during Labor filing? Becase it seems in AC21 I've to mention all those skills. Since I've changed my skills little bit in past couple of years, I don't know what to put now. I don't even know what exactly my ex-employer has used during labor filing.

Ask your previous employer to give you copy of your labor certification...
I did the same.

I don't have a good relation with my ex-employer. And I'm sure that he'll never give me a copy of Labor certificate. Is there any other way to get those papers?

Or shall I put all those skills which I used to work on during my labor filing? If there is a little difference will that make any difference?
 
it is critical!!!

It is important to have the skills list as AC21 states that you can change job but have to work n similar position with similar job responsibilities.

Some time company file under a different category than your position, or the other option is ask someone who was working at the same position as yours and your old employer sponsored him (if he made the copy of labor documents).

Another option: beg, plead, pay your old employer do what ever you can do get the information...

Last option: Take a guess... (I don't know if one should do this... but if you don't have option then...)

This is just my opinion I will advice you to talk to your attorney.

It should be fine

As long as you have a similar job. Just put all the skills you used to work. A little difference shouldn't matter...
Don't worry, just wait for the letter to come and reply with what they requested...
 
Hi,

another thing you can do is to get in touch with an old colleague of yours in your X company and ask him to get you his list of job responsibilities. Usually, companies have a standard format for similar job duties. You might get lucky.
