Hi guys:

I just received an RFE on my 1-140. My lawyer havent received my RFE letter from USCIS. I filed my three applications I-140 on Dec 30, 2004 with ND of Jan 13, 2005. Does anyone received any approvals or RFE on their RFE applications. I havent received any approval on my 1-765. Any feedback, comments.

It seems too early to receive the RFE on 140 as the processing date is Sep 2004. Did you find out what the RFE is about?

My lawyer received my RFE on Mar 21, 2005. They were asking only the original labor subs. THAT's IT. DO you think I can get my 1-140 approval soon once we submit the RFE or is there any possibility that they will ask another RFE. I havent received my EAD approval, maybe because I still have a pending 1-140 , Is this correct. PLease give input about my case.

Did you use sub LC?

I got same RFE asking original labor. My lawyer told me that he sent my original labor and officer just saw copy of it that caused RFE.
He said he replyed the letter. I saw LUD has been updated along with message saying received.

If you applied 140 with a copy of labor cert (since the original employee had applied for 140) then there are people who are waiting for years for INS to locate the original labor certificate either at NVC or consulate abroad. See

Yes I used sub LC. The original LC was used by one of the employee of my company then during the processing of 1-140 they withdraw the case. My lawyer sent a request to DOL for a verification letter stating that the LC was true and certified. I believe they only sent a copy of the LC on my application. Here are my details

SUbs LC- EB3- CSC

1-140;1-485; 1-765 RD 12-30-04; ND 01-13-05
1st FP- 2/18/05 (done) (Fingerprinting
2nd FP 3/05/05 (done) (Biometrics)
EAD pending (my 90 days mark will fall on March 31, 2005.)

I ask my lawyer of getting the iEAD and they said that I might not get my EAD since 1-140 is still pending. Is this true.

Hi bac1209,

I don't understand why you can't get EAD.
I got second EAD approved with pending I140/485.

Why don't you check one more with you lawyer?

I know but they say if you have an RFE on your 1-140, you cant get your iEAD. Unless your 1-140-1485 still pending or untouched.

NO THAT IS TOTALLY WRONG
My ND for 140/485 is in Jan 2005 and I got my EAD within 45 days of 140/485 RD. 140 is still pending.
So you should get EAD even if your 140 is pending. I know of other 3 friends who have also received EADs within 2 months of applying 140/485
If you dont get EAD within 90 days, I heard you can go to local office and get a temp EAD (I aam not sure)

Thanks for your advice. I will make an appoinment with INFOPASS to get scheule in our Local Office. I will give you guys feedback if I can get my iEAD
