Received my RFE today....

BCIS has sent me RFE for Employment letter with position description, salary , hire date and last 2 months paystubs.

I lost my job(laid off) in 2 months after filing for my I485..........do you guys think it might get me into trouble. Sorry for asking again.......I am just panicking here!!!!

I am also in same situation. My total income in 2003 is very less
friend, do you think will it create any problem!!!

If it is for I-485, Seems like u might have to use AC-21. U could contact ur lawyer to make AC21 letter, what job dates will u mentions in it though...? bcoz the dates would indicate that u changed jobs well before 180 days ...

My RD is Jun'2002 and i am in same situation as you, though have not received any RFE or 2nd FP yet. PL keep posting your subsequent details in this thread.

485GCCase : I received RFE for employment letter and 2 months paystubs. I responded to the RFE on tuesday 02/10/04. you do have to worry if you don't have latest 2 months paystubs, so you should be okay.. Try to send RFE response ASAP.

canus_immi: I don't think you will have problem for your low income for 2003. All they need is if you are in job currently and get approximate salary stated in your labor. That's all.. So don't panic and reply to RFE ASAP.

In the employment letter, you must indicate the date of hire..
 
I have question how would INS know that I person changed or got laid off after 60 days of filing I 485. Is that must to sent AC 21 letter to support the case, in case of RFE. I also got RFE for emp letter, 2 pay stub and Medical. I got laid off after 180 days but through the documents they asked its impossible to determine whether person completed 180 days or not.
 
There have been people with only 50% salary as in LC.

There have been people with only 50% salary as in LC. One of them even got approved.

They do not want know also. All AC-21 says is I-485 was pending for more then six months. You may argue that GC was for future job or Layoff of temporary at that time of lay off and you decided not go with the employer after six for some personal reasons by using the privilege given by AC-21.

Just for your info I was laid off just after one month of filing I-485 with pending I-140. I sent the Ac-21 letter. My AC-21 letter did not include start date.
 
Is that must to send AC 21 letter, I talked to my lawyer he didnt say anything about it and said we are going to send the documents which were requested by INS.
 
usually 90 percent of the companies issue the letter reason for lay off.

I dont know as some body in forum said ineffcient and lack knowledge people working at VSC. In present ecnomy lot off people are loosing jobs. I dont know why dont they approve the cases without issuing RFE?? .

vigneshbabu , Thanks for ur info. My new job is in same field. I dont know what to do. My current EAD is expired . VSC is yet approved my EAD . One thing I dont understand why they take somuch of time to prcessing simple things.
 
Law says that, If 485 case is not adjucticated within 180 days then changing the job is not at all a problem, even if some one looses his job after filing 485. At this stage, if someone receive RFE, just send the later employer details and paystubs and that will be fine. GC is for future employment so INS wants to verify his/her job during process of approval. And as per me INS doesn't required to be inform abt AC21, the RFE response is sufficent proof.

cuz, great INS misplaced my first RFE response and they issued a second RFE after 2 months asking for same documents (paystubs and W2) and my lawyer got excuse to make some money out of it by sending rfe response. This country is gr8. :mad:
