Thank you for your recent inquiry seeking information about the status of the 1-140 caseload at the California Service Center (CSC). We are please to inform you that the CSC is actively involved in a major backlog elimination effort for all form types. Based on our current workload projections, our goal is to bring all form types within six months processing time during the next fiscal year.
In October 2003, our pending count was 1.5 million cases; as of July 31, 2004 we reduced this number by half a million cases. We want to assure you that the 1-140 category will continue to be included in our backlog elimination efforts.
We hope that we have adequately addressed the concerns of your constituent.

Now, my opinion.....
Although I understand the reduction in backlogged cases I also know that the I-140 dates have moved only 5 days ahead in over a year. I think that is completely unacceptable and invalidates our right to use AC21. Should we fax a follow-up letter explaining that it is absolutely crucial that the CSC start processing I-140's or else we will never be able to use AC21. Alternatively, the USCIS should ammend the requirement for I-140 to be approved before using AC21.
