Please Help - Received I797C and need to travel to Canada

:( Hi All,

My TN visa expired on May 27 2006. The extension of stay was sent to VSC and I have received the I-797C form confirming receipt of documents and appropriate filing fees with a notice date of May 11. My question is that I have to travel to Canada for 2 weeks. Is this application considered "ABANDONED"? VSC is still processing dates of April.

If you leave the US before the TN is approved, the I-129 is not considered abandoned. If you need to leave, then your option is you could wait abroad until the I-129 is approved, have someone mail you the TN, and then you could reenter using that TN.

The other option, as mentioned in the other post, is if you don't want to wait abroad until someone mails it to you, then you must reapply at the POE.
