Received I-140 RFE

Friends,

Mine is labor substitution case, EB3 category. Applied I140/EAD/I485 on 15th April 2004.
Got EAD last month. But recieved RFE on I-140 from Vermont center yesterday :o .
They are asking certified labor copy from lawyer. I spoke to lawyer and he is saying that he wrote to them already that he does not have that & they should ask this from Deptt. of Labor. He told me he is going to give them same reply again.
Is this reply sufficient? Does anybody had such RFE before? I'll appreciate any suggestions/advice.

My Case is EXACTLY like yours.I filed concurrently(Labor Substitution) on April 15th 2004 at Vermont in EB3 Category.

For my Case the Lawyer did not have the Original Labor Substitution so he had got a Certified Copy from the Dept of labor(and i hope he has really done that) and Filed the same.Its not an uncommon RFE, and can be easily met by your Lawyer by asking for a certified copy from the Dept of Labor.Ask your Lawyer to do that because if he does not and if USCIS has to do that it will take a lot of time(upto Six months)

There have been two Updates for my I-140 on 08/13/04 and 08/16/04 , but there is no change in the Message Staus and no Email.

Did you receive the RFE on your I-140 directly or did you have any LUD Changes prior to receiving the RFE?

Thanks Vicky for replying.

I did had LUD change on I-140 on 10th august'04 but with no message or status change.
The next LUD changed on 24th august and that was this RFE request.

Pls. let me know how long did it took for your lawyer to get certified labor copy from DOL?

My Lawyer told me that he got it from the Local DOL Offices in 3 Weeks.
