Friends,
On 3/25/2005, I initiated enquiry about my pending I485 and today I got reply as follows:

"The case is still pending due to the fact a visa is not currently available. As soon as a visa is available, we will resume processing of the application".

I have few questions about this message and I appreciate yr replies.

1) Did they complete my security (name) check from FBI.

2) Does EB2 also requires visa availability.

2) In how many days I can expect any good news. :) :)

Labor PD: Oct/2002--EB2
I140 RD :Oct/2003 AD Nov/2004 after RFE on ability to pay,several paystubs,3 years W2 and tax returns.
I485 Dec RD 12/5/1003 AD?????? :mad: :mad:

I have received the same letter but my application is EB3. You probably have to check with your lawyer and make sure you applied in EB2 category and dispute it with USCIS. There is no retrogression for EB2 as of right now
 
I don't think visa availability has anything to do with PD. I can say that for sure bcos I got the same letter when the PD had moved to April while mine is Feb.

After I received this letter I got approved within a month or so.

Your approval should be coming in soon.
