Lawyer's office emailed me a copy of the Notice. It is for

2001 W2's
Letter of current employment
3 pay statements

My lawyer's office emailed the doc to my previous comp's email address !! What a jerk !! I have called/emailed them a umpteen number of times telling them that I have changed jobs !!
I do not know if they will present my AC21 case properly.

Guys,

As I have changed jobs using AC21(after 10 months from RD) do my lawyer have to attach some sort of write up along with my documents when replying to INS ?
I am planning to get consultation from Law office of Sheela murthy and if possible get a write-up for AC21 and employment letter format (if at all they provide that for one-time consultations) and get the employment letter from my current employer and send them to my current lawyer.

Please advise.

Hi,

I changed jobs after about 7 months of I-485. At that time(around June 2002) my attorney had drafted 2 letters. One of them was employment letter which I needed to take from my employer.

The other was addressed to the Immigration Directorand explained my Immigration History i.e. how and when the labor was filed and approved, how and when I-140 was filed and approved. It then explained the AC-21 law and all its sections and sub-sections and then argued that it is legitimate to change jobs in the same job field and I should be approved immediately.. :) :)

Unfortunately I do not have copies of these letters :( :( (I seem to have deleted (?) the mail from my attorney). But the 2nd letter had lots of legal jargon in it, is what I recollect still.. :) :)

Incidentally after mutual discussion, we didn't send those letters to INS but decided to send them only if we get RFE.. Another reason why I don't have copies.

I forgot to add in the last post, but I think in addition to the employment letter the other letter is important too..

It was very nicely written by my attorney and made a very strong case for me.. That's how I perceive it, you may or may not send the other letter, as INS has not asked for it... but then it's your decision..

It is good to see your file is moving. I wish you good luck in your RFE and speedy approval. Please don’t worry about “write up” letter. You are fine if you send whatever RFE asks you to provide. If you want, you can send a letter from your current employer mentioning that they are continuing your immigration process. Please don’t worry about it. I don't know exact answer for your question though.

BTW,

my lawyer just faxed me the ETA (labor) approval. They have specified my salary abt 15K less than what I was earning at that time !! (Around Nov 2000). I am an hourly consultant so when it comes to annual salary, they conveniently specied 15K less.
Now, in my new job, I am like 30K more than labor.
My 2001 W2 clears says YTD 8K more than labor. Will this be a problem ?
I am planning to get an employment letter from my current employer w/out specifying the salary, just the job title, job description and starting date? Is it okay?

I believe the AC-21 law states that you need to mention the salary, you can go to isn.org and see the text of (in .pdf format) of AC-21 Act. So I think it is advisable to put in the salary. Also I don't think it will be a problem if you make more or make less than what is specified in the labor.

Again these are my views from reading and studying the AC-21 law for the past more than a year :) :) and I may be wrong too.. Moreover I am not an attorney :) :) (wish i was one, they make good money)..

I guess I have to just make my own format for the employment letter.
If any of you guys have a format of employment letter for this kind of situation..please post.
My lawyer asks me to frame an employment letter and get it from the employer. They are not at all worried/bothered abt this AC21.
I do not know whether it is good/bad to get too much info from this forum. Too much info is too good to confuse !!
