Recapturing vacation time: I cant understand why there are no clear INS rules for this issue

I could not find anty clear rules for recapturing time spent outside country in 6 years H1B span.
Some say it should be unpaid leave
Otheres say it should be work related.
There are som many views.
Why are there no clear cut INS rules regarding
 capturing vacation time outside USA.
Every lawyer has his own opinion
