Hi,

I'm working in company A which I joined after getting laid of from company B.

Can I claim my labor certification which was approved while I was in previous company, company B?

Thanks in advance

Abbas

You can not transfer your previous company's LC to the new company. If you are already applied 140/485 togethar and got your EAD (after 180 days), you can transfer process to new company by
AC21.

But can I before I-485?

My understanding was that if you change job and your application was approved for LC then you have to redo that LC again in new company.

But can I claim the labor from old company if nothing is filed at new company?

Thanks

No, you can not "claim" LC from any employer, it belongs to them, not you. Also, LC is valid for a particular job position (which also means that it is a particular job with a particular employer), so LCs cant be transferred (unless there has been an takeover or merger).

If your old employer is willing to give back your job after you get the GC, it could be possible that the old employer continues with the 140/485 applications - otherwise you are out of luck with the old employer's LC, and will have to restart ylour LC with your current employer.
