Reason (s) for delayed 2nd FP.....

My attorney broke another silence today.

As per the attorney "BIOLOGICAL FORMS" filed with 485 is one of the most important document being looked upon for issue of second FP.

I changed my attorney after filing my 485 in Jan 2002. The new attorney (hired April 2003) is good and is taking care of the minutest details. He has another similar case pending whose 2nd FP notice is delayed. He found out that the biological forms which contain the detailed info about the primary applicants parents details (place and date of births) was not filled out.
Attorney says that earlier it was a common practice to skip the place and date of birth of the father and mother in the biological forms.
But now, it is being considered as an additional info (must required) for issue of 2nd FP. Without this information the application is considered to be having "PENDING NAME AND SECURITY CHECKS".
In this case an RFE may be issued and these bio-forms have to be re-submitted to receive your 2nd FP in 60 days roughly after the RFE is acknowledged.

Another problem now!

To add to the miseries!!!!!

Hope this info is wrong.

I wish I could have seen the 485 application set before it was dispatched. My previous attorney assured me that eveything is fine and filled and I blindly trusted him. In fact, my RD would have been Nov/Dec 2001 instead of Jan 2002 because my attorney took 2-3 months to get all the papers together before filing and that too I had to leterally push him every single day.

But I guess attorneys and doctors generally do not show the contents of the packet. I would urge all the applicants that if possible take a quick look at the contents before it is sealed. You may notice some silly mistake which may become a pain in the rear end towards the approach of approval.


Anybody here who managed to take a last minute look at the envelop and pointed out mistakes (specially spellings) before it was sealed??????

Actually I looked at all the forms and in my case there were atleast 10 typos on biological forms, and there was information which was conflicting in my form and my wife's form such as our present address was different on my form and my wife's form.

I sent all the papers back to the attorney to retype and send me back, second time it happened again, since I already lost more than a month in this, second time I took some correcting fluid and made corrections myself.

It's hard to believe that they didn't show you the forms because you are supposed to sign the original forms.

We did sign but you know in the attorneys office, the atmosphere is such that you want to sign it quickly and that too when the papers are sitting on his desk for months. You really don't want to read each and every line of it. It is presumed that attorney is doing it each and every day and being paid $5000 for it.
Anyway these things can be a good example for all those who are on their way and can be more careful looking at these examples.
