Reapplying LC in EB-2

Hello,

I have a couple of questions regarding re-applying LC in EB-2 category. My current situation is thus:

H1-B: granted on 10/1/2004, extended on 10/1/2007 till 10/1/2010
LC: applied in EB-3 category in May 07, approved in June 07 (Nebraska center)
I-140: applied in June 07, approved in January 09
I-485: applied in July 07 when all EB categories were current

I had an understanding with my employer that they would redo LC and I-140 for me when I was promoted to a position that would qualify as EB-2. That happened over a year back but now the employer is saying they don't have enough money to reapply etc etc.

So my questions are as follows:
1) approximately what are the lawyer fees for re-doing the LC and I-140 applications in EB-2

2) If I were to pay for part of the lawyer fees myself, would that adversely affect the application?

3) Are there any cons to re-applying in EB-2 in my situation?

It is quite likely that you could not now clear labor certification with the unemployment rate of highly qualified US citizens.
