Reappling same K1 visa, two yr waiver?

Hi..mine is a strange case..I applied for a K1 visa in mid 2004..did everything..but during the interview at the consular..they noticed that on my application was a mistake..my fiance wrote "single" instead of "divorced" after showing the consular officer my divorce papers..he said the package needs to go back for adjustment..so now its 2009! no word from them..I still haven't done back to the states on any kind of visa..now I wish to apply for the same again with the same fiance..I think there is a 12 month limit then cases are closed. My question is since I had a prior approved K1 and it reached the US embassy for final processing and its gonna be the same fiance..can she once again apply for my K1 with a waiver on the "must have met within two years" right now we cannot afford to meet in my country..but we love each-other dearly..pls help..Ty in advance.
 
As far as Im aware, USCIS are VERY strict on the meeting within the past 2 years requirement. This waiver is mainly intended for people who are not able to physically meet (ie, have an illness that means they are physically unable to travel, and even then it's difficult to get). Of course, there's no harm in trying, but just be prepared for the likelihood of a denial. If I were you I would try anything possible to ensure that you each met before the application is sent.
