Reapplication after being denied
I am 55 years old and have been in the United States for 17 years. I am married to a US citizen and have two children that were born here.
I was denied citizenship in December of 2000 because I was on probation for a fraud related offence. The probation was later dismissed (June 2001) and my record expunged. I would like to know what affect this has on my reapplication and if the prior fraud constitutes a ban. I was booked and released at a sheriff’s office (Held for an hour) in relation to the fraud offence committed above, does being booked and released mean that I went to jail? In the N-400 naturalization application form how should I answer part 10 Question #21 “21. Have you ever been in jail or prison?” and part 10 Question #16 “Have you ever been arrested, cited, or detained by any law enforcement officer”? Also during the probation I was required to do community service (which I completed) does that mean that I have to answer yes to part 10 Question #19 of the N-400 form “Have you ever been placed in an alternative sentencing or a rehabilitative program”? In the 17 years that I’ve lived here I have not committed any crime or offence other than the one above.
