Hi forum,
Here's my situation, was married before to a USC for 10 yrs, with 1 USC daughter, never applied green card then. Got married again May 2006 with USC, just filed I-485, I-130, and I-765 concurrently to Chicago Lock Box (I live in Ohio). But I havent submitted the Medical exam thing, since I heard I better do that close to my interview. The more I read this forum, the more worried I get, especially about their I-485 got denied.
I've been on B1/B2 visa since march 2005, got extension, went home Dec 05, but at port of entry back to the US, I was detained aside, he told me not to extend my stay anymore, however he let me in until June 23, '06. Even though I never violate anything, immigration-wise. I'm just wondering if this will have any effect for me of not? And for those people that the I-485 got denied, are you trying to get GC by marriage or employment? Please, any previous experience of yours will be appreciated. Thanks.

As far as I know, it is actually best to submit form I-693 (medical exam form) with your application. Failure to do so will most likely delay processing (you will get RFE). I would suggest that you get the medical exam done as soon as possible.

I really think you should be fine with your application otherwise, given that you are married to a USC and have not even overstayed your visa. I suppose it is possible that since you entered on a B1/B2, they could question your intent. Hopefully someone in a similar situation can ease your mind.

I-485 will not be denied for not submitting I-693. You will get an RFE asking you to submit it.
 
Thx Swede and Ari... it's been 6 days now since they've received my package, i'm still waiting for my RD... i guess i'm just too worried about the whole thing. But i'm still curious, if there's anybody out there that applied GC/I-485 by marriage that actually got rejected? I wanna know the reasons. Thx.
 
I think you are looking for the cat's fifth leg...to know the reasons won't help you at all since every case is different.

You probably will received a RFE asking for your medical. Most of the people here are by marriage based and the only case that come up in my mind was the case of a person that the IO did not consider that her sponsor was divorce when all the paperwork was on rule and they had to re-open the case. The rest are not denials but stuck in name check .

I just found out that my checks have been cashed on Jun 1, 06, but I haven't received any letter (receipt) from them. Is it normal? When people said RD on certain date, how many days after that that the letter from USCIS actually came? Any comments will be appreciated, thanks.

Just relax, you have to be patient and wait. If they cashed the checks that means they are processing the paper work. Just be patient and get your medical done ASAP!!
 
Relax. There is a delay between RD and ND. Your RD may be 05/22/06, when they received your package, but the ND could be several days later. ND tells you when they sent the receipt notice to you. The receipt notice is sent via regular mail, so it is as fast/slow as anything else (although who knows how many days it spends in the outbox at the agency before USPS gets it). Just give it some time.
 
Wheeww, thanks guys... I guess it's normal... yes I'm gonna get the med. I'll be waiting for that mail! :mad: Thanks again, I'll update as soon as I get something...please don't get bored at my silly postings :) This is why I never applied GC with my first marriage (10 yrs!), it's just so intimidating for me...

I just hope that you get enough patience from now on until your FP and biometric appointment...and then to received the EAD card...and then the interview letter and if it's approved then the actual card. There is a LOT of wait and patience. Get your medical done.
 
Thank God, we got our receipt mails from USCIS just now... Thank you for all your replies. I do have a small question now (might be a silly one again :) ). I heard about the interim EAD thing (infopass). However, I already sent I-765 with the approriate fee to them. Can I apply interim EAD via infopass now with these receipts? Or after the biometrics? Thanks again.

No, you need to wait 90 days after the Notice Date and if you still haven't got the EAD, you can set up an infopass appointment at the local DO to try to get an iEAD. Now, if a decision had already been made on your EAD application and it was approved, they may not give you an iEAD. But then if it is approved, you should get it in a week's time anyway.
