Here are a few questions that have always been bothering me. I wanted to email this to AILA so that they can get answers from INS for the benefit of EB based immigrants. Can we ask this to them ?

EB based immigration is for a specific job description. How long one has to stay in that job description after approval ?? Eg : One is approved based on Software Engineer position but then decides to get into TV/Radio full time or open a deli/grocery store full time. Can he/she do this. How long has he/she to wait before he/she switches fields. Will it affect when he/she applies for Citizenship ?

Whaddya say ??

"Permanently"

The problem is "permanently" does not mean forever. The best definition of "permanently" that I have come up with is "not temporarily".

Since the GC is for a future "permanent" position, if there was a clear demonstration that you only intended to work for one year, that would defeat the GC, since one year is not "permanent". However, if you in fact worked for one year (most attorneys say six months is usually enough) and then resigned because you decided to do something else, you probably would be ok since one year tends to show that you intended to work "permanently."

I know that\'s not a fantastic, of concrete, definition but it\'s the best I\'ve been able to do. It\'s not an easy thing to answer, at least not accurately.

What about economic factors ?

I believe that reasonability should and would be taken into considerstion by the INS. Especially, if one is more economically well-off, able to live a better life and be able to contribute more to the society by being a deli owner after obtaining GC as a software engineer. I\'m not a lawyer, but I still believe in reasoning based on practicality.
