I need to use AC21 to change my employer ,I have I-140 approval letter and I-485 receipt( passed through 210 days). I dont have my Labour approval and not sure about occupational code used.My employer is not co-operative and is not going to give labour approval copy. How do i proceed with AC21 ?

I have a photocopy of my ETA 750 application part B , which reads occupation as : Programmer Analyst -II .
When i contacted Mr Khannas office , they said Part B job description must be in sink with Part A of ETA 750 (Labour application) and said i need to have a copy of LC to do portability

Gurus please shed some light.

You need enough to know that the job is "similar". Although the LC is the best evidence of this, it is not necessary. You need to get as much as you can though and then go with that.

This might help.
My LC was approved by Chicago DOL.
I used their automated phone system to check on my case status once. I think you need your employer phone no. for getting case info.

They had an option called as Automated LC case status fax back. You can choose to get a auotmated fax of your approval case status. I do vaguely remember that they had my job occupational code listed on it.

Your DOL might have a similar thing. You might give it a shot.
 
Hi Arcs. I am in a similar situation where my employer refuses to give me LC copy. But my LC was approved in Aug 2002. Do you think Dept of Labor would still fax me the copy.

Did you get the faxed copy after you sent in the request ?

You don't get a copy of the labor certification.
You get a fax of your lc case status (approved/rejected/pending, etc. ) and maybe, the job occupational code.
Again, that was the case with Chicago DOL 6 months ago. It might vary for the DOL where your case was processed....
 
Thanks arcs for the information, i have a question here , if my employer applied 100 LC's and just by providing telephone number how do i know status on specific LC.

and can you please give url for DOL automated systems..

And you are right, just entering the employer phone no. might list out all of the cases your company did LC for....

You might try calling the DOL and talk to a rep. Ask them to do a case status check by giving your Employer phone no.
They might be able to retrieve your case no. based on your name.
If they are helpful enough to this point, you might try asking them your occupational code itself directly.
Or, if you just succeed in getting your case no. from them, you might try the LCA fax back option. The fax would have your case no, the status and possibly, the occupational code.

One thing to remember, it did take a couple weeks to get the LCA faxed to me from the Chicago DOL.
