Ready to File Law Suit against BCIS

Hi All,
Rajiv Khanna is willing to file a Law Suit against BCISfor their delays. He needs some strong cases which can justidy the law Suit. Please let us know who wants to be part of the Law Suit ?

Here is an email I have sent out this morning:

Folks, I think we are getting ready to file a law suit against INS for 485 delays. I think we have enough legal support to at least sustain a cause of action. Our team has researched preliminarily some of the law in our support. A member of the community pointed out AC21 also. I doubt if we can file a private law suit to enforce these provisions. But at least we can make an argument. See attached memo. This memo is very rough, so please ignore any semantics that you find faulty.

What I need now from the community now is a list of may be 5 to10 I-485 applicants whose applications have been pending for a long time; who have relatively "clean cases" (degrees from USA, verifiable experience, no criminal background, working with the same employer who is processing the green card and preferably some extraordinary hardship because of the delay).

These people must be committed and make themselves available as needed for speaking with us on the phone. They must sign contracts with our firm agreeing to our representation. They will be charged nothing. But if you folks wish to collect money, please do so on volunteer basis. Vijay Sharma, vijay.sharma@immigration.com can open an account to hold the funds. You can contact him directly. We would certainly welcome contributions from the community. It will help us expend more resources towards the litigation.

Suman ji, our team just needs to meet with me today. I will explain the logistics. Monica, post this announcement in the Moderators' forum also.

Great News!!!!

Lets sue freaking ins. I would have participated in the suite, but don't fit the background Rajiv is looking for. Anybody fitting the requirements please come forward and join the fight.
 
I can fit into the profile Mr. Khanna is looking for except for the "extraordinary hardship" part. Yes, I am angry, frustrated, dissapointed at the whole situation after waiting for over two years. However, I cannot claim "extraordinary hardship" as a result of the delay. I think, if somebody can clarify what will qualify for "extraordinary hardship", it will benefit others thinking about participation.

For others,
There seem to be no genuine candidates with wait time exceeding 24 months :p . How is this possible ?
 
I fits except for Degree from US.

I have priority date of January 2000 and Me and my wife have I 485 Receipt date of Dec 2001. So it is 2 years after filing 485 and may be long enough for a case.

We even didn't get our fingerprint notices so far.

Extra hardship can be that we had to file for 3 EAD and 3 AP and cannot visit my parents because of AP taking more than 6 months .

Iam Still with the same job and same company. Iam willing to participate if the profile is good.
 
Iam sure there are but most of them may not be with the same "Employer".

eg) my RD is June 2001 so more than 2 yrs, but I have changed jobs twice.

Talk to your lawyers. I am sure your lawyer would say that jump on this opportunity as BCIS could get rid of the case by approving you. So all the folks who are browsing this forum (silent or vocal) who meets the criteria please come forward.

There are several hardships everyone faces in such a long GC process. No career improvement, waiting to get AP and cannot visit home country in a timely manner, cannot travel from work, discrimination at work because they know I cannot leave etc. etc. etc. I am sure you folks would know more than I do on this area.
