I've been divorced from my USC ex. since July and plan to file my I-751 removal of cond. within the next week. I have the following evidence:

- Joint Bank Acct. statement from my bank.
- 1 yr lease in both names
- Hospital discharger letter than my wife signed
- Letter from sams club showing both our names
- 2007 Married Filing Joint tax return
- Print out from my employers website showing my ex as beneficiary to my life insurance
- Joint medical insurance (wife as a dependant on my plan)
- Various photos together.
- Cards to / from each other.
- Affidavits (got 1 so far, but presumably I need 3-4 total?)
- Divorce decree.

Do I just mail it all in with the I-751 form loose, or should I have it in a binder, holes punched in it?, cover letter etc?

Thanks

Make sure you follow the new instructions for the I-751. Use the new form and follow the new instructions as to where to file it.

Thanks, I've already completed the new form and read the updated instructions on the USCIS website. It doesn't give any info on how to compile the packet... I guess it's not that important if they don't list instructions for doing so. Only need 2 affidavits... I think that changed from the previous 3-4.

Good luck

I am trying to get a divorce and file form I-751 myself. I have been having problems with my husband and he is now in jail for felony assault.

It is nice to see that you got divorced and filed the form with no lawyer. I consulted a lawyer today who told me that it was going to cost me about $4,000 to finish the divorce and filing the form which I think is crazy because I don't have that kind of money.

So keep posting your process. You have given me courage to do this myself.

Kasonde, you can divorce with less than that and you have a good reason to divorce him! Once you get divorce you can file your I-751 after you get your divorce decree in hand, just remember to get all your evidence.

Remember that divorce is a civil case...you have to get that done first and then you can move on your I-751.

Good luck!

Well, I was quoted about $1500 to do the divorce, then another $5000 for the I-751 waiver based on divorce / legit marriage. The divorce was simple enough so I did that myself. It seemed like the I-751 / immigration part wasn't rocket science and more down to attorney's using fear to earn money. My thinking is that if it gets denied, then I get another chance to prove my case in front of an immigration judge - at which point I'd consider getting an attorney involved. I read the I-751 instructions many times, collected all the evidence asked for, read all that I could on the various immigration forums, and put the package together myself. It should be arriving with USCIS today or on Monday. Seems like most cases for I-751 at California Service Center take about 10wks just now if no RFE's. Maybe I'll have my 10yr card in time for starting 2009 fresh!
