My company is NJ based, They had a small office in DE where they filed my labor in Aug 2003. Backlog Labor of mine just got cleared.
Now my company has closed the office in DE so my lawyer is suggesting me not to go ahead with I 140 for backlog case of Aug 2003.
My lawyer is suggesting me to go ahead and file a brand new perm case from NJ where company head quarter is based. I am not sure what to do. If I go head with new perm, I will loose my backlog date.
They say that there are chances of rejection for I-140 and they have left it up to me to decide about it. My company had not paid corporate tax from DE instead they had paid NJ corporate tax.
Please let me know if I can go ahead and file I-140 from NJ or else what can I do?
