RE: when you can work legally for h-1 extention

Hi,

My h-1 is going to expire on Aug 30 2003. So far, my current company is peding for h-1 extention. They plan to do it by premium process. However, I still stuck at HR for some issue. Here is my question:

1. when can I legally work? Is it when I send out h-1 extention to BCIS or when I got receit notice from BCIS that they receive your case?

2. How long will premium takes? If it is within 15 days, does it start to count when you send your file to BCIS? or does it count when you got receipt from BCIS that they receive your case?

3. When is that latest date that I have to file my h-1 extention?

You can apply for H1 extension 6 months before your current h1 visa expiry date.


Once you get reciept from DOL, u can start working based on that reciept even though ur h1 b visa expired on your passport.


Premium processing would take 15 days from the day they recieve your application....
