Hi !

I have a Friend who is here on an H1B Visa, his visa was expiring on OCT 1st 2003 however on his visit to his home country he got his passport stamped with the new H1B visa valid till oct 2005, his wifes H1B Visa expires in Oct 2003 and so does her I-94 he has submitted the I-539 but not yet heard anything from the BCIS - now will she be out of status after Oct 1st or will they approve the I-539 indicating no lapse in stay - PLEASE ADVSIE !
 
If an application for extension of status is received by BCIS before the current status expires, the applicant continues to be in status pending a decision on the application. Your friend's wife will remain in status as long as the EOS application is pending.
