Re-stamping question for JoeF and Everyone

My I-485 was approved on March 2001. My wife and I got our passports stamped on March 20, 2001 at San Jose.
I received my plastic card in May 2001 but my wife still hasn\'t received hers. She is now working.

Does she need to have the passport re-stamped to continue working beyond the expiration data of the original stamp?

Please advise!

Thanks!

PS: According to VSC, her case has been transferred to "Northern Service Center" which will process it further for the plastic card.

Yes.

I think she needs to re-stamp her passport and send that documentation to her employer.

This is because her employment is based on the old-stamp which expires soon.

I would get the new stamp in any case.

Nebulous

No

I am not sure, but my guess is that if the stamp was valid at the time of filling out the I-9, then the time when the stamp expires is irrelevant, as the Lawful Permanent Resident (LPR) status does not expire with the stamp. The only thing that expires with the stamp is your ability to show to employers or other people that you have status as LPR after the expiration. If you showed your LPR status to your employer before the stamp expired, I don\'t see why you would need to show it again.

My 2 cents.

I am not against peace of mind

However, the I-9 can have several supporting documents, one of them (combination) can be driver\'s license and social security card without restrictive language. In that case there is no need to show the stamp at all.

If someone wants extra peace of mind, it definitely doesn\'t hurt to get the passport re-stamped.

My 2 cents.

Amazing

It is sad, but highly believable that people get confused between validity of the temporary stamp, and preservation of the permanent resident status. I guess not everyone is as informed as we are by reading this board, and INS website :)

Thank you JoeF and Huracan. That was helpful!

Needless to say that I plan to queue up at San Jose INS at 2am very soon :(

Thanks again!

What to bring for re-stamping?

Does anyone know what document should I bring for re-stamping besides passport?

No Title

Your LPR status does not expire with your temporary I-551 stamp in your passport. This is posted at INS official website. However, you should have either I-551 or a stamp in the passport to prove your status.

Q. Will I lose my permanent resident status if I do not renew my Green Card?

A. No, you will not lose your permanent resident status if you do not renew your Green Card—permanent resident status will not expire or change. However, you are required by law to carry evidence of your status/registration (e.g. a valid, unexpired Green Card or the temporary proof of status you receive at the time of filing to renew your Green Card.)
