I am pretty sure this question has already been answered but i am going to query again

I Started working with a company (Nautronix) in San Diego who sponsored my H1-B1. I dec 2002 my status was changed from F1-H1. I went to mexico (Tijuana) and had my H1-B1 stamped on my passport. Unfortunately I was laid off in July 2003.

I found another job (Bristol Babcock) in Watertown CT and they sponsored my H1-B1. I got my new approval notice I-797 with a I-94 attached. My question is

1. I plan to travel to india in DEC. do i need to re stamp my passport with a H1-B1 (for Bristol Babcock)??

2. Validity of the visa: Is the date on the passport only criteria?

3. what documents do i need to show when i come back from India in Jan 2005?

The H1-B1 on my passport currently in favour of NAUTRONIX is valid till NOV 2005

Thank you for your replies

If your old H1 visa (old empoyer)is still valid, you can travel back with your new company's H1 petition and your old valid H1 visa.

At POE, show the old h1 visa and the current employer's H1 petition. Make sure that the immi. officer writes down the expiry date on the i-94 of your new H1 petition and not of your visa.

But do verify this again b4 u make travel plans. I am not qualified to give legal advice, this is based on experiences and posts on forums.

cheers!

Thanks Maverick: My lawyer also confirmed this.

just another dumb question

1. when you say valid visa of the previous employer you just mean the valid / expiry date that is printed on the visa and no other clauses.

Is their a INS posting or link that you can forward it to me. I found a similar link on murthy.com.

Thanks
