Re-filing of I-485

withdraw485

Hello Everyone,

I had my initial I-485 applied from NSC in July'01 and in Dec'02 I withdrew my I-485 in favor of getting married and re-applying after the marriage both for me and my wife. Now,I am ready to reapply the same. I have few questions rather concerns. Thought would check with you guys out there. Appreciate any info you may share.

When my labor was first filed during 03/2000, Company A (corporate office in VSC) filed it from VSC and subsequently filed I-140 from the same service center.
But when company B(Corporate office in Texas) acquired Company A, I-485 was filed from NSC( my work place comes under NSC). Since then, company B has filed and got approval for my immigration petition (I-140) from TSC and also NSC.
My attorney's office decided to re-file it from VSC.
Now if we re-file my I-485 from VSC, will it get denied/returned stating that I do not come under VSC jurisdiction anymore? And if it gets re-directed from VSC to NSC, isnt there a possibility of NSC denying the applications stating that my labor and I-140 were filed and approved from VSC and not NSC ? In the middle of all these issues, I have only 10 months of H1B visa left over.
I know there is lot more to this immigration law and processing that hardly I know or understand and I am sure you guys out there may have some info that can help me decide better.
Thanks so much for any input you may share..

You can apply at service center that has jurisdiction over your intended place of employment (where I-140 was filed) or at the service center that has jurisdiction over your residential place.

Thanks Edison for your reply. My present work place is under NSC jurisdiction and the only reason my labour and I-140 were filed from VSC was, my original compay was in vermont,PA.
Now that my attorney decided to file 485 from VSC, what are the possible issues that may arise, if any?
Thanks so much guys.
