What does Immigration and/or labor law talk about laying an H1 employee off, when the employee is outside the country? If the employer terminates the employment, the H1 Visa ceases to be valid - Right??. Can the person re-enter to take care of vacating/selling his home, taking his stuff etc. Is there a provision for that?
 
As long as your visa is vallid then you should be able to reenter back in the US without any problems. I too was in the same situation. Just make sure that your company does not cancel your H1B visa. You can come back and look for another job if you want to. The imm officers at POE do not have the time and resources to find out if you have been layed off. Hope this helps.
 
I dont have a valid stamp. I dont intend to get one. I am planning to re-enter on AP. My I-140 is still pending.
