Re-entry - pls advice

My mother got a 1 year visitors visa issued in April 2004. Her visa is valid until April 12th 2005. She is currently visiting us. She wants to go back to India in October and return in Jan 2005. When she returns what can the maximum duration of the I-94 be? Will she be allowed to stay only until April 12th (the visa expiry date)? Are there chances of getting a 6 month stamp on I-94, in which case, she will be staying beyond her visa expiry date?

Since my mother wants to stay for 6 months during her next visit, is it advisable to try to extend the 1 year visa at the US consulate?

Also, is there any restriction on when she can re-enter the country? I have heard that she has to have a gap of 3-6 months before the next trip. Is this true?

Thanks in advance for your help

She can get upto 6 months. No relation with the visa. She can stay in US, till her I-94 Expires. I-94 is more important than Visa. I know people who got only 3 months visa and when they entered into US got 6 months I-94. But should enter before expiry of visa.

No...not advisable.

There is no hard rule, but Officer may question her at POE, and may give less than 6 months on I-94. One of my friends mother got only 3 months, eventhough she has 10 years multiple entry visa. She came within 6 months after her prior visit.
