Re Entry Permit

Hi,

My Wife,my 3 years son and myself possess reentry permits valid till December 2009.

We are planing to go back by that time...in the meantime,we learned recently that my wife is pregnant.:)..and should be delivering in August 2009.

I have several questions

1 The new born will have automaically a green card and re entry permit if my wife delivers outside the USA.:confused:
2 If we choose that she delivers in the States,will he or she automatically get the US Citizenship:)
3 We were out of the country for almost one year and half,how can we file for taxes:confused:

1 The new born will have automaically a green card and re entry permit if my wife delivers outside the USA. The child will acquire GC status only if the child and mother return to US before child's 2nd birthday. Mother's GC/Re-entry permit should be valid. The child will not get an automatic re-entry permit.
2 If we choose that she delivers in the States,will he or she automatically get the US Citizenship? If born in the US then child gets US citizenship automatically.
3 We were out of the country for almost one year and half,how can we file for taxes? Even if you had NO US income you should file tax returns; this is a legal requirement. You are also required to show income from outside US.

HOW to file? E-file using tax software and an internet connection, or fill out the return by hand and mail it in!

As a GC holder you are supposed to report your worldwide income on your US tax returns. Whether or not the non-US income is actually subject to US tax depends on the existence (or lack thereof) of tax credits, treaties, and/or exemptions that are applicable to your situation.
