Re-Entry Permit

Our family came to US in the year 2005, in the month of August on family sponsored visas and we, the entire family got the green cards. My children and wife had to go back to our home country, India for continuation of the uncompleted education. They applied & obtained for re-entry permit which is valid for two years, the validity ending by Sep 2007.

My question is that, can we re-apply for re-entry permit to enable my children to complete their ongoing graduation program.

No. You cant re apply for the re-entry permit continuously without visiting US. You have to visit US before the re-entry permit validity gets expired. When you revisit, at that time you can apply for a fresh Re-entry permit. And even some times there will be chance getting delayed to get the re-entry permit or have chances to reject your application, My guess is it will be like 10 to 15 % of chances of rejection. Though you re-apply for reentry permit when u visit US and went back to your country, if you dont get the status of ur application u have to visit US with in 11 months from the time u return back to your country. Let me know if you still have questions.

All the best to your family
