re-entry permit or refugee travel document?

Hello everyone-

Please clarify me in this matter. I am a green-card holder(as principal asylee), but my national passport is expired. In order to travel overseas, do I need a re-entry permit or a refugee travel document?

It depends where you are going and how often you travel. Refugee Travel Document does not need a visa to Germany and most people can also visit europe without a visa once they enter germany. SIngapore also does not need a visa on RTD.

Rentry Permit requires visa for every country. Most countries in the middle east(UAE, Saudi Arabia) do not accept RTD or Rentry permit only NP. Switzerland does not accept Rentry Permit. Rentry Permit is valid for 2 years.

Or you could renew your NP and travel with NP + GC. Lot of people have chosen that route too. It really depends on what you want.

If you tell us where you are going, we could let you know what is the best document to use.

It depends what your intentions are. If you need to remain outside the US for more than six months but less than two years, then you need to apply for the Re-entry permit. If otherwise, then you can apply for the Re-entry permit or the RTD. Also, beware whether or not you need a visa when you are traveling. If yes, then some consulates/embassies do not want to accept a reentry permit as a travel document and you would be required to get the RTD. So, my advice, if staying outside the US for less than six months, then get the Refugee Travel Document
 
WANTMYGREENCARDNOW : What is your opinion on renewing "National Passport" as greencard(former Asylee)? Have you heard any horror stories regarding doing this after getting the GC and later "entering" the US or in the future applying for Citizenship?

Have you heard people getting stopped, questioned for using their "renewed" National passport after travelling outside the US but not to their COP?

- I am still waiting for my GC, however I have lived in the US cor 13years long story and as a resule my national passport expired years ago. I would have to apply for a "new passport" as is the policy in my COP. I was thinking ahead to when I get my GC, if it would ok to go ahead an apply for a new passport and use it for my travel- outside of the COP. I think it presents less hustle than the Travel Documents and RE-entry permit.

Your opinion and anyone else who has one is appreciated. Thanks

This is my take on this issue.

First of all, in adjustment of status adjudication process, I know that they have to verify your entry and exit. See attached interoffice memo:

Now, although the cases of re-opening the original asylum cases are rare, it does happen sometimes if they feel they have sufficient doubt of your claim. One of the conditions of adjustment is that "continue to meet the definition of refugee."-- INA So, if your case is delayed, do you want to sue them? You probably would fear that they might deny you for that reason, even if they do this for retaliation--they are perfectly fine of doing that because that is the law.

Naturalization is a little different because no law says that you should continue to meet the definition of asylee or refugee. I know two people stuck indefinitely... But it all depends on how long it has been from asylum approval. I know if "ernorman" gets GC today and goes back (I know for sure he won't :D ), there will be trouble because barely 1.5 years passed and he can travel to COP for vacation? For you, 13 years is long enough. I think, yes, you should not have problem once you get GC.

I am planning a trip to Italy and Canada. I am not planning to stay a long time, but my lawyer told me that the best way is to apply for a re-entry permit, since I am a green-card holder. It's valid for 2 years, therefore I don't need to worry about renewal.

I do not understand--why would you care about the policy of your COP at this point. I am sure it is also their policy that their citizens not apply for asylum abroad.

I think as long as you don't visit your COP, you can renew your passport.
 
Thanks WANTMYGCNOW! As always I appreciate your opinion.

Some asked why I was concerned about renewal of my NP? Well when I was applying for Asylum one of the things my lawyer told me was that, it is important in establishing legit claim that you do now have any kind of association for instance with the government or COP. Which made sense. If you are claiming Asylum...


I think eventually when I get my greencard, HOPEFULLY soon like yesterday *wink* I will work on getting a new passport. I am not in a rush to go anywhere really. Just like to know my options.

Demand Letter sent in May.

Case filed 06/26/2006 in S.D.N.Y.--i want them to trust every word in my demand letter as much as ones in my asylum claim. :D
