Re-entry permit for a child ???????

Hello Fellow Forumers,

I won the grreen with my child who is 3 years and we relocated to the usa. Being in the usa for sometime ( 2 months) with the child, l have come to the realization that it will better to send the child back to my native country. My movements have become restricted because of the child and l even have to pay huge sums of money on baby-sitting.

Now, I have the following questiuons!!!!!!!!

1. Does a child needs a re-entry permit? If he does, does he require finger printing? How does one start the RE-ENTRY permit process?

2. Assumming, the child doesn't obtain a re-entry permit and stays out of the usa for more than a year, what other options does he have to return to the usa, if by then l am more comfortable to take care of him? Does he have to apply for SB-1 visa or do l need to file for the child ( which may take a long time since l am not a citizen yet)

3. Would surrendering the child' s green be a good option?


Plsssss I need your inputs badly. I am in fix. I want to take a good decision.

SB-1 visa only takes a few days or weeks. It's filing for a whole new green card that would take a long time (4-5 years) because you are not a citizen.

However, the SB-1 visa is a last resort and you should not plan to use it, as you don't know if you will even get it. There is no guarantee of it being approved; you have to prove to their satisfaction that the trip outside the US was originally going to be under a year and unexpected circumstances forced it to be longer than that. And you can only apply for it after the trip has already been more than a year outside the US. So if they reject it, you're left with nothing.

Children under 14 don't need to be fingerprinted for the reentry permit. Download form I-131 and the I-131 instructions from USCIS.
