I got my green card through employment in December 2010. In September 2011, I moved to France my home country where I have been working since. I made sure not to spend more than 6 months outside the USA so I came back to the US in February 2012, June 2012 and December 2012 always for a few days.
I asked the immigration attorney who took care of my GC application if I was jeopardizing my GC status and naturalization and she said I should be fine. But last time in December 2012, the immigration officer advised me to take a re-entry permit (and she wrote on my passeport"advised re-entry permit") and said that they might take my GC if I keep coming back to the US for only a few days. I was already planning to move back permanently to the US in June 2013 to start working full-time on the non-profit organization I created while in the US in July 2011 (I have been working on my organization on my free time while in France) and I could not apply for a re-entry permit right away because I was in the US only for 5 days.
Now, I am afraid to have issues when I re-enter the USA in June and I am wondering if there is something I can do in addition to bring documents showing my ties to the US: bank accounts statements, state ID, tax returns...
- Should I get a new French passeport (so that the immigration officer does not see the written advice or do they have it on their computers anyway)?
- For my non-profit organization, I would like to go to Africa for 2-3 months from August 2013 to launch a pilot project, I plan to apply for a re-entry permit, do you think I'll have trouble to get it because of my extended stays outside the US?
